Is there a legal mushroom dispensary in California?

No. California has no psilocybin license of any kind, and its cannabis dispensaries may sell only cannabis. This page sets out what the city resolutions in Oakland, San Francisco and elsewhere actually do, what happened to the storefronts, and where the state's bills stand.

Can you legally buy psilocybin at a California dispensary?

No. No California law lets anyone sell psilocybin, and a state cannabis retailer license covers only "the retail sale and delivery of cannabis or cannabis products."1 Under state law, possessing psilocybin is generally a misdemeanor with up to a year in county jail and selling it is a felony, the Legislative Analyst's Office wrote in 2023; both are federal crimes too.2

If you decide to order online anyway, My Mushroom Dispensary, run by the same people who publish this register, has a page on magic mushrooms in Los Angeles. Buying psilocybin online or by mail is still illegal under federal law and in every state, California included.

What do the Oakland, San Francisco and other city resolutions actually do?

They ask local police to treat adults' use of psilocybin mushrooms and other "entheogenic" plants as one of their lowest enforcement priorities. None of them changes state or federal law or creates a license, so district attorneys, sheriffs and federal agents can still act. Oakland's resolution covers adults' use and does not license or authorize any shop. Its text, Resolution 87731, lists "planting, cultivating, purchasing, transporting, distributing" among the low-priority activities.16 NPR reported that the measure "does not allow for commercial sale or manufacturing," but the resolution's text never mentions sales.3

California city resolutions on psilocybin, as of November 2, 2026
City and dateWhat it coversSales
Oakland, June 4, 2019Resolution 87731: adults' entheogenic plants and fungi, including "purchasing" and "distributing," lowest priority (unanimous)16No sales exclusion in the text; licenses or authorizes no shop
Santa Cruz, Jan. 28, 2020Adult personal use and possession (record)Sales wording not confirmed
San Francisco, Sept. 6, 2022Resolution 379-22: "planting, cultivating, purchasing, transporting, distributing" and possessing4No sales exclusion, but non-binding and licenses nothing
Berkeley, July 11, 2023Personal use only5Does not authorize giving away, sharing or distributing
Eureka, October 2023Adult use "will not be a public safety priority"6Does not change its approach to commercial sales
Arcata (Oct. 2021), Nevada City (Aug. 2026)Reported (Arcata, Nevada City); we have not seen either textUnknown

Oakland's and San Francisco's texts both name purchasing and distributing, and neither excludes sales. San Francisco's only "urges," and neither binds the state or licenses a shop. Police raided a San Francisco mushroom shop in November 2022, and prosecutors filed three felony counts for selling, possessing and keeping a place to sell psilocybin (register record). Every measure is listed with its source in the California section of the register.

What are California's mushroom dispensaries, and what does the record show?

The register holds 23 California records from June 2019 to October 2026: 7 local resolutions, 6 raids, 4 legislative actions, 3 news reports of shops selling psilocybin, 1 arrest, 1 lawsuit and 1 closure. By the register's own grading, 6 are confirmed, 15 reported and 2 unconfirmed. The storefronts fall into three groups.

Cannabis dispensaries with psilocybin on the shelf. In May 2023 the Los Angeles Times saw psilocybin products on display at two suburban L.A. County cannabis dispensaries, and the L.A. County Sheriff's Department said it had served about 50 search warrants at dispensaries selling magic mushrooms in the previous six months; shops it shut down reopened elsewhere, the department said.7 On Feb. 12, 2026, a task force of Edwards Air Force Base security forces, the DEA's Bakersfield office and the Kern County High Intensity Drug Trafficking Area served warrants at four illicit dispensaries in Rosamond, seized 46 pounds of psilocybin mushrooms, arrested nine people and closed all four.8

Smoke shops. San Francisco police, working with the health department's food and drug safety division and the City Attorney's Office, served search warrants on Sept. 10 and Oct. 9, 2026 at smoke shops in the Sunset and Park districts and seized suspected psilocybin products along with kratom, 7-OH and flavored vapes. The department reported an arrest and said the cases remain open.9 On Oct. 15, 2026, Riverside County sheriff's deputies searched a Wildomar business after a complaint that it sold kratom and nicotine pouches to minors, seized psilocybin mushrooms, kratom and 7-OH products, and arrested one adult on suspicion of possessing psilocybin mushrooms for sale.10

"Churches." Oakland police raided the Zide Door Church of Entheogenic Plants in August 2020 on reports it was operating as a cannabis dispensary without a permit, and seized cannabis, mushrooms and cash; no one was arrested (register record). The church sued the city and its police department in 2022, alleging violations of its constitutional and religious freedoms; we found no ruling.11 A related San Francisco site, Zide Door SF, announced in December 2024 that it would close after city officials said it had opened without required permits (register record). Why the "sacrament for a fee" model keeps failing is covered in the claims storefronts make.

What's the risk if you buy from one?

A dispensary receipt protects no one. Possession is generally a state misdemeanor with up to a year in county jail, and selling is a felony.2 Federal law adds simple possession under 21 U.S.C. 844: up to a year in prison and a minimum fine of $1,000 on a first offense.12 What happens to owners, staff and customers when police arrive is covered in when a shop is raided.

The products carry their own risk, because labels on shop gummies and chocolates have repeatedly been wrong; what testing found in shop gummies has the studies. If someone is in trouble, call 911 or Poison Control at 1-800-222-1222, and see where to get help.

Out of state, or in a clinical trial. Oregon's licensed service centers take adults 21+ who don't live in Oregon and need no prescription; you buy and take psilocybin on site with a licensed facilitator, and "products may not be purchased and taken off-site," the Oregon Health Authority says.13 Colorado licenses healing centers on a similar supervised model. Both are covered on where psilocybin is sold legally and on our Oregon page. Inside California the only lawful route is an authorized clinical trial; AB 1103, in effect since Jan. 1, 2026, speeds state review of such research but changes nothing for buyers (register record).

Is California going to legalize psilocybin?

Not soon. Every bill since 2023 that would have decriminalized psilocybin or licensed supervised use was vetoed or stalled, and the one that passed is about research.

Questions people ask

Are magic mushrooms legal in California?

No. Possession is generally a misdemeanor and sale a felony under state law, and both are federal crimes. City resolutions only set local police priorities; they don't change those laws.

Do California cannabis dispensaries sell psilocybin?

A licensed retailer may sell only cannabis goods. Some dispensaries have stocked psilocybin anyway, which is why the L.A. County Sheriff's Department served about 50 warrants in six months in 2022 and 2023.

Is psilocybin decriminalized in Oakland, Santa Cruz or San Francisco?

Deprioritized, not decriminalized. Each resolution asks police to give adults' use low priority. State law is unchanged, and none of them licenses a shop.

Is it legal to order mushrooms online in California?

No. Mailing psilocybin is unlawful under federal law, and using the mail or internet to arrange a drug sale is a separate federal offense. No state allows mail-order sales.

Will California get a program like Oregon's?

Not yet. SB 1012, which would have licensed psychedelic facilitators, died in committee in May 2024, and no similar bill was moving as of November 2, 2026.
