Do dispensaries sell mushrooms?
Not legally: no state lets a licensed cannabis dispensary sell psilocybin mushrooms, and a store that does is breaking state and federal law. This page cites the rules, explains what cannabis stores and smoke shops sell under the word "mushroom," and shows how Colorado's separate natural medicine system works.
From our sister shop, My Mushroom Dispensary. Adults 21+ only.

Can a weed dispensary legally sell shrooms?
No. A cannabis license is an exception to drug laws for cannabis only, so no state lets a licensed cannabis dispensary sell psilocybin mushrooms, and psilocybin stays a Schedule I drug under federal law in every state.1 Even Oregon and Colorado, the two states that license psilocybin, keep it out of cannabis stores by rule.23
In the cases we've logged, a "dispensary" selling magic mushrooms is usually an unlicensed shop, and the product may not be psilocybin at all. The online shop run by the people who publish this register, My Mushroom Dispensary, keeps a summary of what's legal in each state; ordering psilocybin from it or anyone else by mail is still illegal under federal law and in every state.
What do the rules say, state by state?
Each state's cannabis rules describe what a licensed store may sell, and psilocybin isn't on any list. Here are the rules in the states where shoppers most often ask, plus federal law.
| Place | The rule | What it means |
|---|---|---|
| Federal | 21 CFR 1308.11; 21 U.S.C. 856 | Psilocybin is Schedule I. Keeping any place for distributing it is a separate felony that reaches owners, tenants and employees14 |
| California | Business and Professions Code 26070(a)(1) | A retailer license is "for the retail sale and delivery of cannabis or cannabis products," nothing else5 |
| Michigan | Mich. Admin. Code R 420.203 | A license is "limited to the scope of the marihuana license"6 |
| Oregon | OAR 845-025-1230(1)(b) | A licensed marijuana premises may not overlap a licensed psilocybin manufacturer or service center2 |
| Colorado | 1 CCR 213-1, Rule 2125(A)(2)(e) | Natural medicine premises can't be the same premises as a marijuana license, except for testing labs3 |
| Washington, DC | D.C. Code 48-902.04, cited in ABC Board Order 2024-546 | Psilocybin is Schedule I in DC; the board ordered a shop that had operated as a cannabis dispensary to stop selling it7 |
A licensed store that added psilocybin would be selling outside its license under rules like these, on top of breaking state and federal drug law. Our state-by-state legal guide covers the states with a program or a local measure.
What happens when a dispensary sells psilocybin anyway?
It risks a raid. Many of the cases in our register involve unlicensed cannabis shops that added mushrooms, not licensed stores:
- Los Angeles County, 2023. The Los Angeles Times saw psilocybin products on display at two suburban cannabis dispensaries, and the Sheriff's Department said it had served about 50 search warrants at dispensaries selling magic mushrooms over six months (register record).
- Washington, DC, 2024. The ABC Board found that Supreme Terpene, whose website still called it a mushroom and cannabis dispensary, had stopped selling THC products and was selling psilocybin mushrooms instead. It ordered the shop to stop on July 31, 2024,7 and regulators closed it with police help that September (register record).
- Rosamond, California, 2026. A federal, state and local task force closed four unlicensed dispensaries near Edwards Air Force Base in February and arrested nine people (register record).
- Rome, New York, 2026. Police found psilocybin mushrooms at an illicit cannabis shop, and the state cannabis office padlocked it in April (register record).
Our guide to what happens in a raid covers the consequences for owners, staff, landlords and customers.
What "mushroom" products do cannabis stores and smoke shops sell?
Three kinds of product share the word, and only one is psilocybin. Knowing which is which matters more than the label.
Functional mushrooms
Lion's mane, reishi and similar mushrooms are sold as supplements, sometimes blended with THC. They aren't psilocybin mushrooms. The St. Paul store that billed itself as Minnesota's first mushroom dispensary sold edibles made from nine mushroom species, including three products that mixed mushrooms with THC, and told KSTP that nothing it sold contained psilocybin.8
Amanita muscaria
Amanita muscaria is a different mushroom with different chemistry (muscimol and ibotenic acid, not psilocybin). Shops often sell it as a "legal" mushroom. In December 2024 the FDA said Amanita and its compounds don't meet the safety standard for food, are "unapproved food additives," and recommended "that people avoid eating foods with these ingredients."9 Louisiana makes it a crime to sell products for human consumption that contain it.10 The Tampa store once billed as the first legal mushroom dispensary in the US was selling Amanita, and Florida regulators ordered it to stop selling the edibles (register record).
Mislabeled "magic mushroom" edibles
Gummies and chocolates sold as mushroom products often don't contain what the label says. When researchers tested 12 "magic mushroom" edibles from Portland shops, none contained psilocybin; three held psilocin that looked synthetic, two held other synthetic tryptamines, four had no active ingredient found, and one labeled as containing muscimol had none.11 A second Portland study of eight gummies from smoke and vape shops found psilocin in seven and the synthetic drug 4-AcO-DMT in six; one labeled psilocybin-free contained psilocybin, and two sold as Amanita had no muscimol but did contain psilocin.12 In 2025, Denver's licensing office found psilocybin in a "mushroom" chocolate bar sold at gas stations whose maker said it had none (register record). Our testing guide covers the 2024 outbreak tied to these products.
Does Colorado sell psilocybin at dispensaries now?
No. Colorado runs psilocybin through a separate natural medicine system, regulated by the Department of Revenue's Natural Medicine Division, not through cannabis stores. Psilocybin is given at licensed healing centers under a licensed facilitator, and the state had approved 47 healing center licenses (12 standard and 35 micro) as of October 30, 2026.13 Licensees are "prohibited from selling Regulated Natural Medicine" outside those services.3
Since August 12, 2026, a healing center's owner can hold a Limited Regulated Natural Medicine Sales License. It must sit at the same premises as the healing center and sells to people "taking part in an administration session" there.314 The same law says harm reduction or support services can't be used to conduct sales.14
Separately, adults 21 and older may possess, use and share psilocybin mushrooms "without remuneration" under state law. Remuneration means "anything of value, including money," and the law doesn't cover selling or giving mushrooms away "as a part of a business promotion or commercial activity."15 So "buy a sticker, get free mushrooms" isn't sharing. Our Denver page covers the state's cease-and-desist letters to unlicensed sellers.
Oregon works the same way. Its psilocybin service centers are licensed by the Oregon Health Authority, apart from cannabis shops, and the marijuana rule above bars a licensed cannabis premises from overlapping one.2
Questions people ask
Do dispensaries in Oregon or Colorado sell psilocybin?
No. Both states license psilocybin separately from cannabis. It's given at Oregon service centers and Colorado healing centers during supervised sessions, and the rules keep it out of cannabis stores.
Are the mushroom gummies at dispensaries legal?
It depends on what's in them, and the label often doesn't say. Gummies containing psilocybin or psilocin are illegal everywhere. Amanita gummies aren't a lawful food ingredient according to the FDA, and tests have found psilocin and synthetic drugs in products labeled as something else.
Is Amanita muscaria the same as magic mushrooms?
No. It's a different mushroom with different active compounds, muscimol and ibotenic acid. The FDA says those compounds are unapproved food additives, and Louisiana bans products for human consumption that contain the mushroom.
Are functional mushroom products psychedelic?
Lion's mane, reishi and similar mushrooms aren't psilocybin mushrooms. Some functional products are blended with THC, so check the label for cannabinoids.
What happens to a licensed dispensary caught selling psilocybin?
It would be selling outside its license and breaking state and federal drug law. The cases in our register show search warrants, padlocks and arrests, mostly at unlicensed shops.
