Is it legal to buy from an online mushroom dispensary?
No. Selling, mailing and receiving psilocybin are federal crimes, and no state licenses mail-order sales. This page explains the federal law on mail and internet sales, the seizure and scam risks, and a checklist of what an honest online shop shows.
From our sister shop, My Mushroom Dispensary. Adults 21+ only.

Are online mushroom dispensaries legal?
No. An online mushroom dispensary is a website that sells psilocybin mushrooms, capsules or edibles and ships them, and none is legal in the US: no state licenses mail-order psilocybin, and federal law makes the sale, the mailing and the online advertising separate crimes.123 The buyer is exposed too, because receiving the package is possession.4
If you're 21 or older and decide to order anyway, mymushroomdispensary.com is the shop run by the people who publish this register, and ordering from it is still illegal under federal law and in every state. Whichever shop you're weighing, an honest one shows you six things before you pay:
- A lab report (certificate of analysis) for each batch, from a named lab, with a batch number that matches the package.
- An age check that keeps out anyone under 21.
- A plain legal disclosure saying that buying is illegal under federal law, not "legal in all 50 states."
- Real contact details, so you can reach a person and ask for that lab report.
- Plain packaging, with nothing that looks like candy or a brand-name snack.
- No medical claims.
What does federal law say about selling psilocybin online and by mail?
Every step of an online sale is its own federal offense. Psilocybin and psilocin are Schedule I drugs, and the listing covers "any material, compound, mixture, or preparation" that contains them, so the mushrooms count, not just the pure chemical.5
| Law | What it makes illegal | Penalty or effect |
|---|---|---|
| 21 U.S.C. 841(a)(1) | Selling or distributing a controlled substance, in any amount | Up to 20 years in prison for a Schedule I drug like psilocybin1 |
| 21 U.S.C. 841(h) | Delivering, distributing or dispensing a controlled substance "by means of the Internet" without authorization | A separate federal offense1 |
| 21 U.S.C. 843(b) | Using the mail, phone or internet to commit or arrange a drug felony | Up to 4 years per use, or 8 with a prior drug felony conviction2 |
| 21 U.S.C. 843(c)(2)(A) | Using the internet to advertise or offer to sell a controlled substance that federal law doesn't authorize | A separate federal offense2 |
| USPS Publication 52, section 453.31 (18 U.S.C. 1716) | Mailing a controlled substance unless both sender and recipient are DEA-registered or exempt | The mailing itself is unlawful3 |
| 21 U.S.C. 844(a) | Possessing a controlled substance without a prescription or other authorization | Up to 1 year in prison on a first offense4 |
For a seller, one order can turn into several counts: the sale, each call, message or mailing that arranged it, and the website menu itself. For a buyer, the main federal exposure is possession.
State law doesn't fill the gap. Oregon lets clients buy and use psilocybin "only at a psilocybin service center," and its law aims to "prevent the diversion of psilocybin products from this state to other states."6 Colorado bars its licensees from selling regulated natural medicine outside supervised services, and its new sales license has to sit inside a healing center.7 So a website that says it's "licensed in Oregon" or "licensed in Colorado" and ships to you isn't operating under that license. Our guide to the claims shops make covers that one and six others.
What happens if a package is seized?
The order is gone, and so is the money. The Postal Service tells its staff that nonmailable controlled substances found in the mail "must be immediately reported,"3 and the parcel carries the buyer's name and address.
Online sellers get prosecuted, and the Postal Service helps. In September 2026, federal prosecutors unsealed an indictment against the operator of a DC website that took drug orders, including for psilocybin mushrooms, and delivered them in person. ATF led the investigation with help from the US Postal Inspection Service, and agents seized about 74 pounds of psilocybin mushrooms.8 A seller that's shut down can't fill orders already paid for. Our DC records show how often shops there have been closed.
Are online mushroom dispensaries scams?
Some are, and it's hard to tell which from outside. Because the trade is illegal, there's no license to look up, no regulator inspecting batches, and no license board to complain to if an order never arrives. Even the search results are a warning: when we searched "online mushroom dispensary" on November 2, 2026, the top eight were mostly seller promotion in disguise, including keyword spam pages, paid posts on news sites marked as promoted content, and a job listing for a seller's blog writer.
Products sold this way have the same problems testers find in shops. When researchers tested 12 "magic mushroom" edibles bought at Portland shops, none contained psilocybin and 8 held ingredients the label didn't list.9 In September 2025 the FDA warned an online seller that its Amanita muscaria "microdose" capsules, tincture and chocolate were adulterated under federal food law.10 Our testing guide covers what labs found.
What should an honest online shop show you?
Here's why each item on the checklist matters. None makes a purchase legal; they tell you whether a seller is being straight with you.
A lab report for every batch
A certificate of analysis is a lab report for one batch. In Oregon's licensed program, a manufacturer "must order tests for every batch of finished psilocybin product" to measure psilocybin and psilocin.11 On a seller's report, look for the lab's name and accreditation, a batch number that matches your package, a test date, and results for psilocybin, psilocin and contaminants. A report from an unnamed lab, or one that doesn't match your batch, proves nothing about what you'd get. Our menu guide has the full checklist.
An age check
Both licensed programs are for adults 21 and older, and an honest seller holds the same line. Teenagers show up in the illness data: of 178 people with a known age in the 2024 mushroom-chocolate outbreak, 24 (13.5%) were under 18.12
A plain legal disclosure
An honest site says buying psilocybin is illegal under federal law and that no state allows it by mail. "Legal in all 50 states," "licensed in Oregon" and "protected by decriminalization" are false for psilocybin. So are claims of federal compliance: in 2025 Denver's licensing office found psilocybin in a "mushroom" chocolate bar whose maker said it contained none and complied with DEA rules (register record).
Real contact details
You should be able to reach a person by email or phone and get a lab report on request. A shop that hides behind a contact form can disappear with your order.
Plain packaging
Packaging shouldn't look like candy or a brand-name snack. In a 2025 study of Canadian psilocybin stores, 30 of the 46 stores whose products it assessed (65.2%) sold products resembling brand-name foods.13 Young children are swallowing more psilocybin products: in national poison-center data, the rate of unintentional psilocybin mushroom ingestions among children under 6 rose from 0.06 per 100,000 children in 2018 to 0.94 in 2024.14
No medical claims
In the same Canadian study, 19 of the 22 store websites with health content (86.4%) made mental-health claims, while few carried warnings: 2 (9.1%) warned about driving, 3 (13.6%) about pregnancy, and 7 (31.8%) about psychosis, schizophrenia or bipolar disorder.13 An honest shop does the reverse: no promises to treat anything, and a clear note on who shouldn't take psilocybin. Our microdose page lists the exclusions clinical trials use.
Questions people ask
Can psilocybin be mailed legally?
Not to a consumer. The Postal Service allows controlled substances in the mail only when both the sender and the recipient are DEA-registered or exempt. No shop or customer is registered to send or receive psilocybin.
Is a website that says it's licensed in Oregon or Colorado legal?
No. Oregon keeps purchase and use inside licensed service centers, and Colorado's sales license only covers people in a session at a healing center. Neither license allows shipping.
Does a lab report make an online order legal?
No. A certificate of analysis can tell you what's in a batch. It doesn't change the law: psilocybin is Schedule I whether it's tested or not.
Are microdose capsules sold online accurately labeled?
We found no published US lab study of psilocybin capsules bought online. Studies of shop edibles found labels often wrong, so treat any potency figure without a matching batch report as unverified. Our microdose page covers what testing has found.
