New York mushroom dispensaries: what the law and the raids show
There is no legal mushroom dispensary in New York: the state licenses no psilocybin seller, and we found no New York city that has even made it a low police priority. This page covers the storefront cases, what possession means, the bills in Albany and the nearest legal options.

Is there a legal mushroom dispensary in New York?
No. New York has no psilocybin license of any kind, and possessing any amount is a crime under the Penal Law.1 Police have found psilocybin in shops in Manhattan, the Bronx, Carmel and Rome, and fifth-degree criminal sale, the charge filed in the Manhattan and Carmel cases, is a class D felony.23
If you decide to order online anyway, My Mushroom Dispensary, run by the same people who publish this register, ships to New York. Buying psilocybin online or by mail is still illegal under federal law and in every state.
Doesn't legal cannabis cover mushrooms in New York?
No. New York's Office of Cannabis Management (OCM) regulates cannabis and has no psilocybin license to issue. When OCM, State Police and Rome police searched an illicit cannabis shop on April 8, 2026, they recovered psilocybin mushrooms, and OCM padlocked the shop.4
Unlike DC, Ann Arbor or Detroit, no New York city or county has a measure making psilocybin a low police priority, as far as our research found. Every state's status is on are mushroom dispensaries legal.
What are New York's mushroom shops, and what does the record show?
DoubleBlind reported in July 2024 that "scores" of New York City businesses sold illegal psilocybin products, mostly East and West Village smoke shops and some bodegas, often as branded chocolate bars and gummies. It gave no count and said raids appeared rare.5 No agency publishes a count either: Sheriff and OCM releases group mushrooms with cannabis.
The register holds 10 New York records dated Dec 20, 2022 to April 8, 2026 (every New York record). Five are enforcement records (three raids, one arrest and one plea), and all four raids and arrests found psilocybin by name. Four are state bills, and none is a local measure.
What happened in the 2022 East Village case?
After undercover buys, NYPD narcotics officers searched two East Village storefronts on Dec 20, 2022: a CBD store selling from a password-access back room, and a smoke shop. At the CBD store they seized nearly 1,500 psilocybin mushroom pills plus bagged mushrooms, gummies and chocolate bars; at the smoke shop, a psilocybin chocolate bar. Four people were charged with fifth-degree criminal sale, criminal possession or both, the Office of the Special Narcotics Prosecutor announced on Dec 22, 2022.6
DoubleBlind later reported that one of those cases ended in a disorderly conduct disposition with community service and two years' probation; we found no other report of the outcome.5
Do the Sheriff's padlock sweeps find psilocybin?
Sometimes. New York City's Operation Padlock to Protect, which began in May 2024, targets unlicensed cannabis shops.8 In a July 16, 2024 sweep of 51 locations, the Sheriff's task force found "psilocybin mushroom edibles" at one Bronx location and "psilocybin edibles and psilocybin concentrate" in a warehouse reached through the back door of a Bronx bodega; the city said 639 shops had been sealed to date.7 By Dec 4, 2024 the Sheriff reported more than 1,298 shops shut citywide, with no count of how many held mushrooms.8

What happened outside New York City?
In Putnam County, the Sheriff's narcotics unit made three undercover purchases at a tobacco shop in the Town of Carmel, then on March 4, 2024 arrested one person and seized psilocybin mushrooms and marijuana products from the shop. The charges were three counts each of fifth-degree criminal possession and criminal sale (Penal Law 220.06(1) and 220.31), class D felonies.3
In Rome, on April 8, 2026, OCM, State Police and Rome police searched an illicit cannabis shop, Mothra Madness, with the Oneida County health department also responding, and recovered about 800 grams of psilocybin mushrooms. OCM padlocked it; the release lists no arrests.4
What does buying mean for a customer in New York?
Possessing any amount of a controlled substance such as psilocybin is criminal possession in the seventh degree, a class A misdemeanor (Penal Law 220.03).1 Above the weight thresholds in Penal Law 220.09, it becomes a class C felony.9 Federal possession law applies too.
The product is the other risk: no state rule tests or labels psilocybin products sold in unlicensed shops; see what testing found in shop gummies and chocolates. If someone has a bad reaction, call 911 or Poison Control at 1-800-222-1222; our help page lists more lines.
Where is the nearest legal option for New Yorkers?
There is no walk-in retail dispensary and no take-home or mail-order sales anywhere in the US. The legal settings closest to New York are narrow:
- New Jersey's hospital pilot: P.L.2025, c.296, approved Jan 20, 2026, creates a Department of Health research pilot at three hospitals (northern, central and southern regions) under FDA and DEA rules.10 It has no retail or take-home provision, and which hospitals were selected had not been announced in the sources we checked as of Nov 2, 2026. It is a research pilot for patients, not a place to buy psilocybin.
- Colorado: 47 healing centers (12 standard, 35 micro) approved as of Oct 30, 2026, run supervised sessions for adults 21+.11
- Oregon: adults 21+ consume psilocybin "only at a psilocybin service center" under a licensed facilitator.12
- Federally authorized clinical trials, for enrolled participants.
