Federal prosecutors charge the operator of a DC online delivery service that sold psychedelics

On September 10, 2026, ATF announced an unsealed federal indictment against the operator of Forest Floor DC, a website that took orders for marijuana, mushrooms and DMT and delivered them in person in Washington. Agents reported seizing about 74 pounds of psilocybin mushrooms, a reminder that DC's Initiative 81 covers only non-commercial conduct and does nothing to shield a sales business from federal law.

What happened?

According to a September 10, 2026 release from the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), an indictment was unsealed in federal district court and the defendant made an initial appearance.1 We don't name people charged with crimes.

The indictment charges conspiracy to distribute and possess with intent to distribute DMT; distribution of DMT and MDMA within 1,000 feet of a private college; and distribution and possession with intent to distribute MDMA. It also includes forfeiture allegations.1 The counts listed in the release name DMT and MDMA. None names psilocybin, although psilocybin mushrooms were among the items seized.

ATF says the business, called Forest Floor DC, took orders through a website for Schedule I substances including marijuana, mushrooms and DMT, and the defendant or an associate delivered them in person. Law enforcement made several controlled purchases that way.1 We name the business only because the federal release does; we don't link to it.

Seized items, per ATF: about 74 pounds of psilocybin mushrooms, about 18 pounds of marijuana, about 30 pounds of THC, about $250,000 in US currency, about $200,000 in jewelry, and a handgun with ammunition.1 ATF's Washington Field Division High Intensity Drug Trafficking Area task force led the investigation, with Homeland Security Investigations, Metro Transit Police and the US Postal Inspection Service assisting. The release notes that every defendant is presumed innocent until, and unless, proven guilty.1

Why does it matter if you're looking for a mushroom dispensary?

An online menu with local delivery is still a drug sale. DC's Initiative 81 asks the Metropolitan Police Department to make "non-commercial" conduct involving entheogenic plants and fungi among its lowest enforcement priorities; it does not cover selling them, and it changes no federal law.2 The ATF release does not mention Initiative 81 or any "gifting" arrangement.1

Federal law treats the online part as its own problem. Using the mail, phone or internet to arrange a drug felony is a separate federal offense, and so is using the internet to advertise or offer a controlled substance for sale without federal authorization.3 Those sections are not among the charges the release lists here, but they are why our guide to online mushroom dispensaries says buying psilocybin online or by mail is illegal under federal law and in every state. Our DC guide covers the storefront padlocks, the Initiative 81 rulings and the risks for buyers, and DC's dated record is in the register.

What happens next?

The release gives no trial or plea dates, and we found none as of November 2, 2026. The case will move through federal court, where the charges must be proven. We'll update this post when there is a public outcome.
