FDA hears public input on how psychedelic drugs could be given in supervised settings

On September 14, 2026, the FDA held a public hearing on how psychedelic drugs, if approved, could be given to patients in supervised settings: provider training, safety, access and data. The agency said up front that it was not taking comment on legalization, decriminalization, state programs or non-medical use, so the hearing was about prescription medicine, not dispensaries.

What happened?

The FDA announced the hearing in a Federal Register notice published July 14, 2026, titled "Considerations for Potential Future Therapeutic Use of Psychedelic Drugs; Public Hearing; Request for Comments" (Docket No. FDA-2026-N-7542).1 The hearing ran from 12:30 to 4:30 p.m. Eastern on September 14, 2026, in person at FDA's White Oak campus in Silver Spring, Maryland, and online. Written comments were due by 11:59 p.m. Eastern on October 5, 2026.2

The notice set the scope as drug products containing a psychedelic drug substance used "in supervised and supportive settings," with four topics: training and credentialing of providers, patient safety, access (insurance coverage, treatment capacity and telehealth), and standards for collecting data.1 It said FDA was not seeking comment on drug scheduling, legalization or decriminalization, the merits of state or local programs, or religious, ceremonial or personal non-medical use.1

The notice tied the hearing to Executive Order 14401, "Accelerating Medical Treatments for Serious Mental Illness," signed April 18, 2026.1, 3 That order directs FDA to give national priority vouchers to qualifying psychedelic drugs with Breakthrough Therapy designation, directs FDA and DEA to set up a pathway for eligible patients to get psychedelic drugs under the federal Right to Try Act, and tells the Attorney General to review any Schedule I product that has completed Phase 3 trials for a serious mental health disorder, so that rescheduling, if appropriate, can follow quickly after FDA approval. It does not name psilocybin and says nothing about retail sale.3

No decisions were made at the hearing. KUNC and NPR reported that speakers stressed standards for training providers, and noted that copying clinical-trial levels of supervision in everyday practice could be expensive.4 The law firm Foley Hoag reported that FDA also finalized guidance titled "Psychedelic Drugs: Considerations for Clinical Investigations" around the time the hearing was announced.5

Why does it matter if you're looking for a mushroom dispensary?

The federal path being built is for specific prescription drugs given under supervision, not for selling mushrooms. FDA put state programs and non-medical use outside the hearing's scope, and psilocybin and psilocin remain Schedule I drugs. If a psilocybin medicine is approved, it would be a particular pharmaceutical product, prescribed and given under supervision; it would not make storefront mushrooms legal. One company, Compass Pathways, has said it expects to finish its psilocybin drug application this year, as our post on its filing explains.

For now, federal law allows psilocybin use only in authorized clinical trials. State law alone allows licensed sessions in Oregon and Colorado and a few narrow patient pilots. Our guide to licensed psilocybin centers covers each, and are mushroom dispensaries legal? sets out federal and state law.
