New Mexico takes psilocybin producer applications and weighs rules for its medical program

New Mexico began taking applications from would-be psilocybin producers in August 2026 and set an October 2 public hearing on the rules that will govern patients, clinicians and treatment sites. The program is medical and supervised, it has not opened to patients, and it will not include stores.

What happened?

New Mexico's Medical Psilocybin Act (Senate Bill 219) was signed in April 2025 and took effect June 20, 2025. The Department of Health lists the qualifying conditions as major treatment-resistant depression, post-traumatic stress disorder, substance use disorders and end-of-life care.1 The act also lets the department approve other conditions.2

The department opened applications for producer permits on August 17, 2026, through its Center for Medical Cannabis and Psilocybin, with no deadline and review in the order received, according to a department spokesperson quoted by HealingMaps. We found no department release confirming the date. As of September 2, permits for clinicians and testing labs had not opened.5 Marijuana Moment reported on October 14 that the state had issued its first producer permit; we have not seen that confirmed by the department.6

On the rules, the department first noticed a hearing for August 28, 2026,4 then issued a second notice setting a public hearing for Friday, October 2, 2026, at 9 a.m., in Santa Fe and online. The hearing covered a new rule, 7.35.3 NMAC, plus amendments to the producer rules, including a section on transportation. Written comments were due by the close of the hearing.3 The proposed rule covers patient enrollment and certification and the operation of certifying clinicians, practitioners, facilitators, healing centers, "other approved locations" and educational programs.3

Marijuana Moment counted about 80 written comments. Objections included a requirement that certifying clinicians examine patients in person, patient ID cards with a 30-day state review, written landlord consent for in-home care and healing centers, and staffing ratios.6

Why does it matter if you're looking for a mushroom dispensary?

New Mexico's program will not sell psilocybin over a counter. The act protects a qualified patient "taking psilocybin in an approved setting" and directs the department to set the approved settings, so patients with a qualifying condition will receive psilocybin under supervision rather than buy it at a store.2 The draft rule's mention of "other approved locations," and the comments about in-home care, suggest that sessions may not always happen at a clinic, but they are still supervised.3, 6

Until the program opens, there is no New Mexico psilocybin card for a seller to honor, and because the act ties a patient's protection to an approved setting, a card won't cover buying by mail or from another state. Psilocybin stays a Schedule I drug under federal law. Our guide to licensed psilocybin centers compares New Mexico with Oregon, Colorado and the patient-only pilots in New Jersey and Utah, and the law itself is in the register's New Mexico record.

What happens next?

The department's program page says "The program is set to be implemented by December 31, 2026."1 The act itself sets a later legal deadline of December 31, 2027.2 On September 2, HealingMaps called the 2026 target unlikely.5 As of November 2, 2026, the department had not announced final adoption or an effective date for 7.35.3 NMAC, or dates for opening clinician and lab permits. We'll update this post when it does.
