San Francisco police seize suspected psilocybin products in smoke shop searches
San Francisco police said on October 21, 2026 that search warrants served at smoke shops in the Sunset and Park districts turned up suspected psilocybin products along with kratom, 7-OH and flavored vapes. One arrest was made, and police say the cases remain open.

What happened?
The San Francisco Police Department's release #26-132, issued October 21, 2026, describes search warrants served at several smoke shops in an investigation focused on businesses in the Sunset and Park districts.1
At one shop, searched on September 10, 2026, officers seized items suspected of containing psilocybin mushrooms, along with kratom and 7-OH packets, flavored tobacco and vapes, nitrous oxide canisters and glass pipes. At a second shop, searched on October 9, 2026, officers seized more than 200 flavored vapes, more than 400 kratom products, psilocybin products and other items.1
The release says an arrest was made and the cases remain open. It gives no number of arrests, no quantities for the psilocybin items and no lab confirmation that they contained psilocybin.1 The SFPD Alcohol Liaison Unit worked with the Department of Public Health's Division of Food and Drug Safety and the City Attorney's Office.1 We don't name the shops or the person arrested, and we give no location below the neighborhood level.
Why does it matter if you're looking for a mushroom dispensary?
California has no license of any kind for selling psilocybin. Under state law, possessing psilocybin is generally a misdemeanor and selling it is a felony, according to the state's Legislative Analyst's Office.2 A smoke shop that stocks "mushroom" products next to kratom and vapes is not a dispensary in any legal sense, and in this case police, health inspectors and the City Attorney's Office worked together.
San Francisco's own policy doesn't change that. In 2022 the Board of Supervisors adopted Resolution 379-22, which urges that investigating and arresting adults for planting, purchasing, distributing or possessing entheogenic plants be among the city's lowest priorities.3 It is a resolution, not a license: it changes no state law and authorizes no shop. Weeks after it passed, a mushroom shop opened in the Haight; police raided it in November 2022 and prosecutors filed felony counts, as the register records. It isn't the only recent California case: in February 2026 a joint federal, state and local task force closed four unlicensed dispensaries outside Edwards Air Force Base, a raid that is also in the register. Our California guide covers the state's other city measures and enforcement cases.
There's also the question of what these products contain. Lab tests of shop "mushroom" gummies and chocolates have found labels that don't match the contents, including synthetic compounds that aren't psilocybin at all. Our guide to what testing found in shop gummies lays out those studies. If someone becomes sick after taking a product from a shop, call Poison Control at 1-800-222-1222, or 911 for trouble breathing, a seizure or someone who can't be woken; our help page lists more lines.
What happens next?
As of November 2, 2026, we had found no announcement of charges by the San Francisco District Attorney and no civil action by the City Attorney against the shops, and police had not reported lab results on the suspected psilocybin items. We'll update this post and the register's California records if any of that changes.
